The year 2023 was significant for India’s constitutional and democratic institutions. As the year before the General Elections to the Lok Sabha, it witnessed important developments across the Legislature, Executive and Judiciary.
This article looks at some key events from the perspective of governance, institutional functioning and public accountability.
Legislature: A Busy but Challenging Year
Parliament held four sessions in 2023 — Budget, Monsoon, Special and Winter. Each session had its own legislative and political significance.
According to publicly available legislative data, the productivity of the Budget and Monsoon Sessions was affected by disruptions, while the Special Session and Winter Session recorded comparatively higher functioning hours.
The Special Session was notable for the passage of the Women’s Reservation Bill and discussions around India’s achievements in space research.
The Winter Session also drew attention due to a serious security breach inside Parliament. Following the incident, discussions around parliamentary security, accountability and the role of elected representatives became important topics of public debate.
The year also saw strong debate between the Government and Opposition on issues such as parliamentary procedure, legislative scrutiny and discussion on important national matters.
Executive: Policy Decisions and Institutional Role
The Executive continued to play an active role in governance and lawmaking throughout the year.
Several important policy and legislative decisions were taken, including changes related to criminal laws, appointments to constitutional bodies and administrative governance.
One key area of discussion was the use of ordinances. Ordinances are constitutionally permitted in urgent situations, but their use often invites debate on the balance between executive action and legislative deliberation.
Another important development was the discussion around appointments to constitutional institutions, including the Election Commission. The issue raised wider questions about institutional independence, accountability and the process of appointments.
The year also saw discussions around digital regulation, online content moderation and the balance between national interest and freedom of expression.
Judiciary: Important Constitutional Questions
The Supreme Court and High Courts heard several significant matters in 2023. These cases touched upon constitutional interpretation, federalism, elections, civil liberties and institutional powers.
Some major legal developments included cases related to Article 370, same-sex marriage, the relationship between Governors and elected State Governments, demonetisation, electoral bonds and political party disputes.
The Supreme Court delivered important judgments in several matters, while some cases continued to remain under consideration for the following year.
The judiciary’s role in protecting constitutional values, interpreting laws and balancing institutional powers remained a key part of public discussion throughout the year.
